Terms of service

These Terms of Service ("Terms") govern your use of the Aeon Frost store at aeonfrostcapsulecorp.myshopify.com and every purchase you make from it. The store is operated by Aeon Frost Capsule Corp ("we", "us"), an independent software company in Ontario, Canada. By placing an order you agree to these Terms, our Refund Policy and our Privacy Policy.

1. What we sell

We sell downloadable VST3 audio plug-ins for Windows ("Software"). Nothing physical is shipped. Minimum requirements are stated on each product page (currently Windows 10/11, 64-bit, and a VST3-compatible host). It is your responsibility to check them before buying.

2. Orders, prices and payment

Prices are shown in Canadian dollars unless your local currency is displayed, and include or add applicable sales taxes as shown at checkout. Payment is processed by Shopify and its payment partners (including PayPal where offered). We never see or store your full card details. An order is accepted when you receive our order-confirmation email. We may refuse or cancel an order in cases of suspected fraud or an obvious pricing error; if we cancel, you are refunded in full.

3. Delivery

Your download link is delivered by email and on the order-status page immediately after payment. If it does not arrive within one hour, check your spam folder and then email contact@aeonfrostcapsulecorp.com.

4. Licence

The Software is licensed to you, not sold. On full payment we grant you a personal, perpetual, non-exclusive, non-transferable licence to install and use the Software on computers you own or control, for any musical purpose, including commercial music production. Audio you create with the Software belongs to you; we claim no rights in it.

You may not: (a) share, resell, rent, sublicense, upload or otherwise distribute the Software or your download link; (b) reverse-engineer, decompile or disassemble the Software except to the extent the law expressly permits despite this restriction; (c) remove copyright or ownership notices; or (d) use the Software to build a competing product. The licence ends automatically if you breach these restrictions.

5. Intellectual property

The Software, its presets, interface, graphics, names and this store's content are owned by Aeon Frost Capsule Corp and protected by copyright and trademark law. "Aeon Frost" and the product names are our trademarks. VST is a trademark of Steinberg Media Technologies GmbH. Windows is a trademark of Microsoft Corporation. Other product and DAW names are trademarks of their owners and are used only to describe compatibility; no endorsement is implied.

6. Refunds

Digital sales are final, subject to your statutory rights. See our Refund Policy.

7. Compatibility and your responsibilities

Before buying, you must confirm your system meets the minimum requirements on the product page. You are responsible for your computer, operating system, DAW, drivers, audio interface, third-party plug-ins and for keeping backups of your projects and data. Always back up before installing any new software. We provide free installation help at help@aeonfrostcapsulecorp.com, but we cannot guarantee compatibility with configurations we do not list as supported.

8. Safe use and hearing

Audio software can produce sudden, very loud or distorted output, particularly with extreme settings, feedback routing, faulty drivers or third-party plug-ins in the chain. Always monitor at safe levels, lower your volume before loading presets or changing settings, and use a limiter on your master bus. You use the Software at your own risk. We are not responsible for hearing damage, damage to speakers, headphones or other equipment, or any injury arising from the volume or content of audio you produce or play back.

9. Disclaimer of warranties

Except for the limited promise that the Software will perform materially as described on a supported system (remedied under our Refund Policy), and to the fullest extent permitted by law, the Software and this store are provided "as is" and "as available", without any other warranty or condition of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, or that the Software will meet your requirements or be compatible with future versions of Windows, your DAW or other software.

10. Limitation of liability

To the fullest extent permitted by law, Aeon Frost Capsule Corp and its owners, contractors and suppliers are not liable for any indirect, incidental, special, exemplary, punitive or consequential loss or damage, or for any loss of data, projects, recordings, audio, profits, revenue, business, goodwill or equipment, or for DAW or system crashes, arising out of or related to the Software, this store or these Terms, however caused and even if we were told it was possible. Our total liability for all claims relating to a product is limited to the amount you actually paid for that product.

11. Misuse and indemnity

We are not responsible for any use of the Software that breaches these Terms or the law, including use to infringe anyone else's copyright or other rights, or any modification, combination or use of the Software with hardware or software we did not supply. You agree to indemnify and hold harmless Aeon Frost Capsule Corp from claims, losses and costs (including reasonable legal fees) arising from your misuse of the Software, your breach of these Terms, or content you create or distribute with it.

12. Your consumer rights

Some jurisdictions do not allow certain warranties or liability to be excluded. Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded, including under the Consumer Protection Act, 2002 (Ontario), or liability for fraud, or for death or personal injury caused by negligence. In those cases our exclusions and limits apply only to the maximum extent the law allows.

13. Acceptable use of the store

You must not attempt to gain unauthorised access to the store or its systems, interfere with its operation, scrape it in bulk, or use it for anything unlawful. Good-faith security research is welcome: report findings privately to legal@aeonfrostcapsulecorp.com.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction, except that if you are a consumer you may also bring proceedings where the consumer law of your country or province allows.

15. Changes, severability and entire agreement

We may update these Terms. The version in force when you place an order governs that order. If any part of these Terms is found unenforceable, it is limited to the minimum extent necessary and the rest remains in force. These Terms, the Refund Policy and the Privacy Policy are the entire agreement between you and us about your purchase. We are not liable for delays or failures caused by events beyond our reasonable control. Our failure to enforce a term is not a waiver of it.
